Alec Baldwin Will Be Charged With Involuntary Manslaughter in ‘Rust’ Shooting

Alec Baldwin is expected to be charged with involuntary manslaughter after he fatally shot cinematographer Halyna Hutchins during rehearsals for the movie Rust back in 2021. Baldwin has maintained he wasn’t aware that the gun he fired on set contained a live round. The actor and film’s armor Hannah Gutierrez Reed will be charged with two counts of involuntary manslaughter, according to prosecutors. The shooting resulted in a whirlwind of allegations of negligence from those involved and involved a lot of finger appointing.

Hutchins was struck and killed by a live round of ammunition that was fired from a prop gun being held by the actor. He still maintains that he did not pull the gun’s trigger. Director Joel Souza was reportedly also injured in the incident.

According to a post-mortem investigation into Hutchins’ death, which was signed by a New Mexico chief medical investigator, the cause of death was listed as a gunshot wound to the chest, and the manner of death was listed as an accident. 

“Review of available law enforcement reports showed no compelling demonstration that the firearm was intentionally loaded with live ammunition on set. Based on all available information, including the absence of obvious intent to cause harm or death, the manner of death is best classified as an accident,” the report stated.

According to an FBI forensics report, the weapon couldn’t be fired during FBI testing of its normal function without someone pulling the trigger while the gun was cocked. The report also stated that the gun eventually malfunctioned during the testing after internal parts were fractured, which then caused the gun to go off into the cock position without actually pulling the trigger.

During an interview with CNN back in August, the actor had placed responsibility for the tragedy on Gutierrez-Reed, who back then served as an armor and props assistant on the film, as well as assistant director Dave Halls, who handed him the gun.

Halls had signed a plea agreement “for the charge of negligent use of a deadly weapon,” according to the District Attorney’s office that announced the statement. Prosecutors stated that the terms of that certain deal included a 6-month probation time.

      • Absolutely, the prop man is to blame, and you can’t tell me the prop man didn’t know that was a live round!!!

      • This was not another actor she was the cinematographer. The gun was a Colt 45 revolver not a scatteringing gun, so why would you be pointing a gun at your cicinematographer? and pulling the trigger?

      • Obviously some of you are not familiar with a gun of this type, nor gun safety, Obviously neither is Alec, you have to pull the hammer of this gun back to fire it, once you do that, when the hammer hits the primer,… boom. So he is absolutely at fault. The only other way is for you to drop the gun hitting the hammer which hits the primer, they now install safety features to revolvers now so that doesn’t happen. Don’t play with guns!

      • You never depend on anyone else to do things for you, you always double-check to make sure what your doing is correct and safe before you do it. Baldwin didn’t do that, so he must accept the responsibility. No one is accusing him of doing anything intentionally, it was an accident, but someone has died from it. What is making it worse is Baldwin’s attitude and trying to “pass the buck” and blame someone else, it’s time to be a man and accept what has happened.

  1. @CeeMills Did you not read that they said the internal mechanism of the gun was messed up and it went off on its own. He didn’t pull the trigger. They’ve already established that. Reread the story.

    • That’s not what was written- it said during testing the gun “fractured” making it fire without the trigger being pulled. It did not fracture and misfire for Mr Baldwin. If it did fracture prior -the gun would have been found fractured immediately upon the examination by forensic investigators. The gun only fractured after testing

      • All guns are to be treated as if they were loaded real or not, until proven different by the holder of said weapon. If u don’t know this then u have no business handling it. Alex knew this, he spent his whole career badmouthing lawful gun owners trying to get Congress to ban all weapons while he played around on set like he was a professional & better than others.

  3. Im not sure about the politics of Hollywood. But what I do know is, in New Mexico State there are no Union laws for film production companies to abide by. So many independent films have taken more and more projects there. So I believe when Akec Baldwin confronted union crews or crew members they had no union authority in New Mexico, he was set up by dismissed members of the crew. Because if I remember right, there were discussions of that nature earlier in the week, or it may have even been that day. This way the Unions could cause controversy in the New Mexico film industry.This way the Unions can demand that New Mexico become a Unionized state for the film industry. It smells to me like a set up. But that’s what he gets for taking Unionized film production crews to New Mexico in the first place. They set him up for firing the union crews. Who are they? They know who they are. We know, they know, we know, who they are. They are those who are members of the Synagogue of Satan the religion of Tel Aviv. Akec Baldwin is a descendant of Baldwin, King of Jerusalem. Who are they? Peasants.

  4. Common sense dictates that when you are going to be handling a firearm, you should know how to check it and make sure it is unloaded and the safety ( if it has one) is engaged. Many actors learn about guns before they handle them. Remember the first Red Dawn movie with Patrick Swayzee and C. Thomas Howell? The kids in that movie went through six weeks of rigorous training and even had to sleep with their guns! They wanted to make sure they knew what they were doing and that no accidents occurred. This should be done on all movie sets where weapons are used.

SO WHO BROUGHT IN SHIP,ENT OF BLANKS, ENDER WHOEVER IS AT FAULT, AND PERSON WHO LOADED GUN, AND SHOULD BE A 2 nd to check gun and bullets. All three of those persons are responsible, not Alec.   10. There was no where in the article that stated he pointed the gun at her. A gun can be fired and someone hit, without pointing it at a target.
    My feeling is that it was an accident, just like the coroner’s report stated.

    • It probably was an accident but was still caused by negligence hence the reasoning for manslaughter instead of murder. No different than a drunk driver wrecking and killing a passenger or someone else, It was an accident and they didn’t mean or intend to do it but negligence on their part caused it.

  12. How could Alec Baldwin possibly know if gun was loaded with live or blank rounds? If he pulled ALL rounds out of the gun, wouldn’t ALL the shells LOOK THE SAME? Do blanks and live shells LOOK different or do they look the same? If they look the same, anyone along the line of manufacture could have inadvertently put a live round into a box of blanks! It might have been a manufacturers machine error when a machine loaded the shells into the box for sale. Maybe the last live round stayed in the loading machine and became the first round in a run of blanks boxes!

  13. Why on earth is a gun with live rounds doing on a movie set… if the guns are for drama purposes only (and not to actually shoot someone.)
    So why is there EVER a real gun with real bullets on a movie set?
    None of this tragedy make sense to me.

    That weapon was used earlier in the day for ‘plinking’ at targets in the desert, by several movie production staff.
    It was never a harmless ‘PROP’ gun.

  15. If found guilty, his punishment should be prohibited from performing in movies, tv shows, press conferences, and any other means of transmitting his face or words to the general public or anyone else again. Not even zoom.

    He is stupid, and dumb, yes he held the firearm, but did not load it. He was set up.
