Halyna Hutchins Family to Sue Alec Baldwin for Fatal Shooting in Rust Incident

The parents and sister of cinematographer Halyna Hutchins, who was killed on the set of Rust in 2001, have revealed they plan to sue Alec Baldwin for her death. Attorney Gloria Allred announced via a press conference on Thursday.

Halyna was shot by a gun that was held by the actor while setting up a camera shot during rehearsal on the New Mexico set of the western film. Baldwin was charged last month with two counts of involuntary manslaughter with prosecutors alleging he was distracted during the gun training and went on to show Reckless deviation from standard safety protocol on set. The actor has maintained he didn’t pull the trigger despite FBI forensic reports finding that the gun couldn’t fire without a trigger being pulled.

Armor Hannah Gutierrez Reed, who oversaw the handling of weapons on set, was also charged with two counts of involuntary manslaughter. Assistant director Dave Halls, who Baldwin stated he told him the gun was cold meaning it contained no live ammunition, made a plea agreement with prosecutors to negligent use of deadly weapon charges. Joel Souza, the film’s director, was also struck by the same round but luckily survived.

It still isn’t clear how a live round made it onto the set in the first place, and Gutierrez Reed denied knowledge of it. Her attorney stated that she was under “extreme pressure” and was “rushed”  on set as she was juggling two jobs and now she will be “ exonerated of wrongdoing.”

Both Gutierrez Reed and Baldwin are scheduled to make their first court appearance,  on February 24th. Hall’s plea conference is scheduled for March 8th.

Mathew Hutchins, Halyna’s husband,  previously settled a lawsuit with Rust producers, of which the actor was one, followed on behalf of himself and the couple’s young son. Part of the settlement terms includes Hutchins taking the role of executive producer on Rust, which is supposed to resume the production with Baldwin in the lead role.

 After criminal charges were filed, Matthew’s attorney, Brian Panish,  stated in a statement they supported the charges, saying their own independent investigation also supported charges.

Luke Nikas, attorney for the actor, says the decision to file criminal charges, “distorts Halyna Hutchins’s tragic death and represents a terrible miscarriage of justice. Mr. Baldwin had no reason to believe there was a live bullet in the gun — or anywhere on the movie set. He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.”
