Going home from a concert, the couple was both drunk and high, according to the Palm Beach Post, while speeding down a road. Notebaert’s late wife was also sitting in his lap — the couple’s clothes below the waist were missing — presumed to have been engaging in intimacy at the time Notebaert accidentally drove into a canal. His wife’s head hit the dashboard and the windshield when the car rose 30 feet in the air. She died on the scene.

On Wednesday, a judge handed the Loxahatchee, Florida man a sentence of five years in prison.

Circuit Judge Laura Johnson had called the incident a “senseless” and “tragic” act, says the Palm Beach Post. Johnson brought up his criminal record, as he had previously been convicted for reckless driving.

“This isn’t your first chance,” she told him. “You failed your wife, you failed your children and you failed all your family that is here today.”

During sentencing, Notebaert told Johnson, “I miss her more than words can express.”
