Spacey, 63, is accused of sexually assaulting Anthony Rapp in Manhattan in 1986 when Rapp was just 14-years old. The trial will also be held in Manhattan, with a federal judge ordering jury selection to begin on October 6.

Rapp, also an actor, alleges that Spacey “invited Rapp over to his apartment for a party, and, at the end of the night, picked Rapp up, placed him on his bed, and climbed on top of him, making a sexual advance,” BuzzFeed wrote. Rapp and Spacey were performing in Broadway shows together at the time.

Spacey tried to have the case thrown out this past June, but Kaplan shot down those attempts. Instead, Kaplan will allow “claims including third-degree sexual abuse to move forward to trial, while tossing out a sexual assault allegation due to the statute of limitations,” the New York Post reported.
