Don’t Be a Hero: The injuries sustained by Charles Ochlech could have been avoided, but he wanted to be a hero. When the roof collapsed, he rushed to save people from the debris. While pulling the collapsed roof from the other Family Dollar shoppers, he strained himself mentally and physically.
- Charles Ochlech is claiming that while moving rubble from other folks in the store, he hurt himself. His list of damages includes permanent injuries to his neck, back, and legs. Obviously, he hadn’t read the memo about lifting in a gentle, leg-dominant way.
- As well as his bodily damage, Ochlech is claiming that the incident on the Family Dollar roof collapse has damaged him mentally. He says that he is suffering from PTSD, anxiety, and emotional stress. You can’t jump into hero mode and then moan about it afterwards.
Seeking Damages: Now that the whole situation is over, the man is looking to claim reparations from the Family Dollar store. Being hailed a hero wasn’t enough; he wanted payment, too. He says he needs money for medical bills, lost wages, and reduced earning capacity.
Next time he has the chance to be the hero, I think he should probably sit it out.
Preventable Accident
According to the lawsuit, the roof collapse at the Family Dollar was completely preventable, and should have been. The roof collapse was caused when a car crashed into the store, destabilizing the structure.
- A support beam that had been holding up the roof was dislodged. As a result, the roof collapsed on a number of shoppers. It transpired that the shop owner had never applied for a permit to repair the roof, despite the shoppers in the building
As a result of the roof collapse, 68-year-old Larry Banks was killed. It also critically injured a 50-year-old woman and injured two others. It was during this tragedy that the man attempted to pull people from the collapsed rubble, injuring himself in the process.
Looking to get some cash from his heroics, he is suing the store.
