Crystal Thomas, 33, was arrested after her child asked the school nurse for Vaseline to cover the tattoo, per the New York Times. The nurse then called the police.

The boy had asked his mother if he could get a tattoo of his name in large block letters. She consented, according to the Mid-Hudson News. This was obviously a problem since the minimum age to receive a permanent tattoo in New York is 18. Other states do not have an age limit.

“No little child should get tattooed,” Thomas told the Times. She added that she thought her son was getting a temporary tattoo and she supports New York’s age restriction.

Thomas has been charged with endangering the welfare of a child. The Town of Lloyd Police relayed on their Facebook page.

Austin Smith, 20, was the tattoo artist who was arrested after pictures of the boy’s tattoo began to circulate on social media.

“It’s the worst mistake I’ve made in my life,” Smith said. “At the time, I thought if you got your parents’ permission, you could get a tattoo.”

The boy told the Times he was inspired to get a forearm tattoo by the tattoo of his favorite teacher. Who yes, has one on his forearm. He said Smith shouldn’t have agreed to give him one of his own.

“He should have said no,” the boy told the Times.

Smith was charged with dealing unlawfully with a child and faces a prison sentence of up to a year.
