A Mexican judge just dismissed a sexual assault case, and his reasoning is baffling

It seems that America isn’t the only nation where wealthy young men can enjoy a slap on the wrist for sexual assault violations. On Monday, Judge Anuar Gonzalez ruled that 21-year-old Diego Cruz was innocent of sexually assaulting a schoolgirl because he acted “without carnal intent,” essentially declaring that because Cruz did not enjoy himself when he violated the victim, he is innocent.

The case captured international attention, and Cruz, along with the three other men (all from well-off families) were branded “Los Porkys” on the internet. The incident occurred as the victim was leaving a club on New Year’s Eve and was forced into a Mercedes, where Cruz and his friends were waiting. She claimed that she was taken to a mansion near the Gulf of Mexico and raped by another one of the men. Cruz initially disappeared to Spain but was extradited to Mexico to face justice.

Shortly after the attack, the 17-year-old victim wrote an impassioned Facebook post in which she asked, “I’ve gone drinking, I’ve gone to parties […] For that I deserved what happened?” The family of the victim continued to pressure authorities to investigate the incident, and after several months, they finally got their wish.

Cruz apologized on a recording released by the victim’s father but later said he was forced into the apology. One of the other men accused is still missing. According to the Los Angeles Times, the victim’s father reacted angrily, saying “imagine, any adult can touch any person, of whatever age, and go free by saying it was not lascivious, and that there was no intent to have sex.”
