Reese Witherspoon Officially Files for Divorce From Jim Toth with Prenup in Place

Reese Witherspoon has officially initiated divorce proceedings following her announcement of the split from her husband, Jim Toth. The reason cited for the divorce in court documents obtained by PEOPLE is “irreconcilable differences,” with the filing date listed as the date of their separation. The couple has a pre-nuptial agreement in place and has mutually agreed to share joint custody of their 10-year-old son, Tennessee James.

Witherspoon and the talent agent announced their divorce via a joint statement last Friday, a few days before their 12th anniversary. “We have some personal news to share…” they stated. “It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness and mutual respect for everything we have created together.”

“Our biggest priority is our son and our entire family as we navigate this next chapter. These matters are never easy and are extremely personal. We truly appreciate everyone’s respect for our family’s privacy at this time,” the duo added.

According to a source via People, the two will still remain “best friends.” “This is such an amicable decision. They are so committed to co-parenting together. They are invested in their whole family and making this as smooth as possible for everyone,” the source stated.

Witherspoon and Toth got married in March 2011, and have a 10-year-old son named Tennessee. Witherspoon also has two children, 23-year-old daughter Ava Elizabeth and 19-year-old son Deacon Reese, with her ex-husband Ryan Phillippe.
