Reese Witherspoon and Jim Toth Have a Prenup, Will Split Custody of Tennessee

Reese Witherspoon hasn’t had the best luck in love. The Your Place or Mine actress is officially divorcing for the second time in her life, this time from her husband of almost twelve years. Reese and Jim Toth made a joint announcement about their decision just over a week ago. According to a source close to the actress, Reese Witherspoon is leaning on friends for support amid the upheaval.

Reese Witherspoon Is Feeling “Positive” Thanks to Her Support System

Not everyone has a good support system especially when it comes to matters of the heart. Fortunately for Witherspoon, she’s kept a tight circle of gal pals whom she can depend on.

“Reese has many girlfriends that she leans on. She always had a large group of close friends. She has a lot of support,” an insider told People. “She is positive about her future.”

Despite working out the details of sharing custody of their 10-year-old son Tennessee, Witherspoon and Toth seem to be on the same page. The source added that the ex-couple are putting their kid first, and beyond that there is no animosity.

“Reese is moving on,” said the insider. “There is no drama and she’s just focused on her son. She and Jim share custody. They want things to be as smooth as possible for Tennessee.”

Reese Witherspoon posted the joint statement from her and Toth to Instagram on March 24. It was only two days before their 12-year anniversary.

“It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness and mutual respect for everything we have created together,” they wrote.

Witherspoon deactivated the comments and further requested respect for their family’s privacy. “Our biggest priority is our son and our entire family as we navigate this next chapter,” the statement continued. “These matters are never easy and are extremely personal.”

Witherspoon and Toth reportedly have a prenuptial agreement in place and remain “best friends.” They have agreed to split custody of Tennessee, who turned 10 last September. “Tenn” is the youngest of Witherspoon’s three children. She also has a son, Deacon (19) and daughter Ava (23) with her first husband, actor Ryan Phillippe.

Deacon and Ava are close with Tenn and have both shared adoring posts about their little brother. Although their mom keeps posts about her youngest to a minimum, he does have a bit of an online presence. That can lead to fans having their own opinions, which it seems like the family wants to avoid.

Witherspoon and Toth Have Grown Apart

Although Reese Witherspoon has a support system, the decision to divorce from Toth has left her “disappointed and upset.” A source told People that the Legally Blonde actress “never saw herself getting another divorce.” They added that Toth and Witherspoon’s relationship moved quickly once they started dating, but that the two are very different people.

“Reese is headstrong and focused. Although very hard-working, Jim is more laidback,” said the insider. Jim Toth was a talent agent with CAA (and once represented Jamie Foxx) but currently is on the board of directors for a tech company. While both Toth and Witherspoon have made space for their own ambitions, they seemed to grow apart over time.

“She has her hand in a lot of pots; he prefers less frenzy,” an insider revealed.

One film industry source said Toth and Witherspoon have “been spending less and less time together while she was working” and another said they now have “fewer interests in common.”

Despite Divorce, Witherspoon and Toth Are Still Friends

Witherspoon has openly praised Toth over the years since they met at a mutual friend’s house in 2010. She’d just broken up with actor Jake Gyllenhaal and was being harassed by a drunk friend. Toth came over and saved the day and the two started dating the following month. Witherspoon later told Elle that the first interaction made it evident to her that Toth was “a really good friend” and “a really good person.” They married after dating for just over a year.

“[My husband’s] an incredible man, a wonderful organizer, a great leader. He knows how to get people together,” Witherspoon told People in 2016.  “He’s very patient and funny with the kids. And he really encourages them to see the humor in life.”

The actress also credits Toth for being a pivotal inspiration in her career switch to producing. She told Harper’s BAZAAR that he encouraged her to just start doing it because he recognized her potential and passion.

Just one year ago, Witherspoon and Toth were celebrating their anniversary and “11 years of adventures” together. It is shocking to say the least, to see it all end. The now estranged spouses jointly filed divorce papers on March 30.

“Reese was thrilled by his attention and excited to marry him,” said a source, adding that divorce was “difficult” for Witherspoon to accept but necessary after they grew apart. “They both concluded this was right for them.”
