Burke was fired from her job as a neonatal nurse at the Good Samaritan Hospital in West Islip. The incident occurred on February 6, and Burke turned herself into the Suffolk County Police Department on April 12. The situation was investigated for two months by officials before it was decided that Burke would be charged with a crime.

Sinclair told officials that while his 2-day-old child was in the NICU while receiving antibiotics, he witnessed Burke stroll over to his crying newborn baby. This is when Sinclair saw the woman pick his baby up, turn him over, and slam him back into the crib onto his face. Luckily, Sinclair caught the incident on video and showed it to the higher-ups at the hospital, and an hour later, Burke was informed that she was fired and she must leave the hospital immediately. Thankfully, the newborn, named Nikko, wasn’t badly injured and is doing well at home with his family.

Burke’s Lawyer Robert C. Gottlieb claims that Burke should not be held legally responsible for the incident because the baby was not badly injured. In a statement, Gottlieb said, “This case should never have resulted in criminal charges. Amanda is an outstanding, exemplary, compassionate nurse who did not and would never do anything to endanger any infant or patient under her care. The baby involved was not injured or ever placed in any danger of injury. The District Attorney’s statements are off base and not justified by all the facts that will come out in court.”

Despite the charges against her, Burke is still a registered nurse. She will be arraigned on May 2.
